Terms and Conditions

 

General

  1. Mark Lindstrom (the photographer) retains full copyright of all images together with the right to use images, for promotional purposes, for example on his web site or social media feeds, without recourse or compensation to the client.
  2. No image taken by the photographer will be subject of sale to third parties for commercial concerns without the permission of the client.
  3. Any order placed using a deferred payment process such as cheque or BACS, will not be processed until the payments have cleared.
  4. Where a payment has failed to clear within 14 days, the order will be cancelled by the photographer and the client will have to re-order. Any such re-order will be subject to prices and/or discounts applicable at the time of this new order as apposed to that existing at the time of the original order.
  5. Prices are subject to change due to increases by suppliers, though this does not apply to items already ordered and acknowledged (except in the circumstances mentioned above).
  6. All orders are checked by myself prior to submission to the printers or released for download, to ensure that the best quality image is being offered. 
  7. Naturally, any watermark displayed during the purchase process will be removed from the delivered image.
  8. All images are provided strictly for personal use only; see below for more details.
  9. Personal use includes: printing images from the file, copying files, storing images on fixed or removable media, and publishing images to personal social media and personal web sites. Where images are published to social media / web sites, the photographer requests that due credit be afforded. This licence also extends to distributing the images (either electronically or in print) to friends or family members where no gain is obtained and where the intended use is for non-commercial purposes. Recipients of such copies are also bound by this licence.  The written permission of the photographer must be obtained for any use other than personal use.
  10. Commercial use includes, but is not limited to, the promotion of a businesses, sale of images to third parties, etc.

Print Orders

  1. All prints are printed to order by one of the country’s premier print houses, and are therefore expected to be of the highest quality. If any item is found to be defective then please contact me as soon as possible following receipt of the delivery.
  2. As items are made to order I am unable to facilitate a return or replacement due to a change of mind.
  3. All print orders are subject to postage and packing costs.
  4. Any special discounts and offers exclude costs associated with postage and packing.

 

Digital Downloads

  1. Where digital files have been provided as part of the order, they will be provided as JPEG files. The Photographer is not liable for any issues that may be incurred in playing back such images due to the incompatibility of the client’s equipment.
  2. Copyright of the photographer extends to such digital images though a perpetual licence is granted to the client placing the order, to use them for their own personal use where no gain is involved, whether financial or otherwise. Use of images for commercial purposes will be subject of a separate licence and additional charge; please contact the photographer for details
  3. The printing of files on behalf of the client by third parties is covered by this licence; however, no use of these images may be made by the third party beyond fulfilling the print request of the client without permission of the photographer.
  4. The quality of images produced from digital files is governed by various factors, such as the quality of the monitor, printer, inks and the paper used. The image is also affected by the configuration of such equipment which includes such things as colour profiling. Some variation in colouring may therefore be experienced to that intended by the photographer. By not using the photographer’s printing process the client takes responsibility for the quality of the finalised output. The images have been processed using the sRGB colour space, which is the more common format for screen devices and commercial print labs.
  5. The suitability of an image to be displayed / printed at a specific size will be governed by its resolution; these limitations will be highlighted within the purchase option. 
  6. As I check each order prior to releasing for download, there will be a short delay before the link is delivered to you. This should not be more than a couple days at most.
  7. Once an image has been downloaded I am unable to facilitate a return or replacement due to a change of mind; please ensure that you have chosen the correct image prior to completing the purchase. Should you discover that you have selected the incorrect image prior to downloading it, then please contact me; but do not download it, I will be able to confirm from the system whether the file has been downloaded.
  8. The copying or distribution of files, images and discs outside of this licence is in contravention of copyright. 
  9. The client indemnifies the photographer from any improper use of the images supplied.
